To be more specific… the states that will charge you sales tax if you have affiliates or partners located in that outside state?

Every state with a sales tax will charge sales taxes on Internet purchases if the customer and the seller have a common nexus.

A few states are attempting to establish a nexus through affiliates and advertising partners. CO and NY are among them. It will be up to the courts to decide if this is legal. Until an aggrieved party steps up to sue this practice will likely continue or even expand. Sellers have tried suing in CO and NY but have had their cases thrown out of court, the rationale being that they are not injured by the practice but merely act as agents for the state in collecting the taxes. Until a customer decides to sue don’t be too surprised if this practice becomes fairly wide-spread.

almost 6 years ago i joined one of those adult videochat sites and started promoting it. At the time i joined they said - lifetime earings on what a member spends, that joins from your affiliate link.-

In fact even now on the page of their revenue sharing program page it says
"For every $ a registered viewer spends per-minute watching live interactive video feeds, you receive up to 40% forever and without restrictions! "

Then I was expecting a payment for money, and did’nt recevie, I contacted them and I get this email from them telling me their new tos:

Thank you for contacting us.

Under the new CamSense Terms & Conditions (Effective Date: December 1, 2009) in order to continue receiving payments from CamSense, a person must either have a CamSense account that complies with the minimum traffic requirements i.e. to deliver at least 5 qualified spenders per month; or chathost account that complies with the "active chathost" requirement of conducting at least one live session in a 60-day period.

Please be aware that the new CamSense Terms & Conditions were implemented on December 1, 2009. Every affiliate received an email detailing the changes on December 1, the announcement was posted on CamSense News Section and the terms were posted on the Camsense site on the same day. You will note that the new terms clearly state that CamSense has the option to discontinue the payouts for your referred visitors who have become qualified spenders on a CC Network site upon your failure to meet the criteria for an Active Affiliate over a two (2) month period.

There have been too many cases in which affiliates have not been actively working to send new traffic to our sites for months, in some cases years, and have still been collecting commissions on past spenders. Meanwhile, there are other affiliates who have been working hard to deliver new traffic to our sites each month. These partners are much more invested in the current success of our business, and it is those affiliates that we want to ensure are rewarded for their efforts.

For the last 60 days you delivered 0 spenders to CC Network sites . Unfortunately this means that currently your account doesn’t meet CamSense requirements and you forfeit the commissions from the lifetime revenue of past spenders.

Please keep in mind that your CamSense account is not being closed.
Lifetime commissions (on new spenders only) will be reinstated right after you regain Active Affiliate status i.e. deliver at least 5 qualified spenders per month to a CC Network site.

How can they change the terms of a contract they have with me from 2004 through 2009???

Basicly what they are telling me is that if I don’t send MORE visitors to their site, (that sign up and spend money) I lose any money I would have earned pior to their tos change on December 1, 2009.

I do not agree to these terms changes. Nor would I have ever aggreed to such terms.

So, Should not anyone that joined by my link before December 1, 2009 fall under the prior tos? I did work and promote the program and more then a few of these members are still spending on the site.

If there is anone else out there that has been effected by this and is losing their money, contact me and let me know your story as this effects you.

My best guess is that this is far from legal. However, I am not a lawyer. I would recommend getting one, and maybe seeking some punitive damages.

On a side note, I don’t **** over my affiliates like that, so if you come this direction you may be less stressed.

I know about ESPN3 but my provider (time warner cable) is not an affiliate partner with ESPN3 so I can’t watch. I have follow hundreds of posted links here but non was free.

A friend of 3 months got me into the club promoting business. We formed a team of 3 people and I came up with the name of the group, which he later took after we split after an argument. The separation was over some money issues and miscommunication. He spent more than he earned and also wanted me to be putting extra money into things that I wasn’t completely in favor of "to party the night on a bigger scale".

One night we had an argument because he wanted me to chip the full tip of an alcohol bottle (the bottle was free for us since we are promoters) and I told him that it wasn’t fair for me to cover the whole tip ($40) when everyone (5 people) were drinking, then he went off to say all type of things and also to terminate our relationship without giving me much of chance to say anything as he wasn’t listening, this was in front of everyone and the club manager. I handle him $15 and said the rest of you should cover the rest, and left.

The issue. After we split, I called him on the phone 2 days after and told him that we should have a meeting because the way that everything went down is not "team playing" and that theres was a lack of communication. He answered that there was nothing to talk about and that anything that we needed to talk about was already said. Then hanged up.

Today (2days later), I came home and found that he slipped a whole bunch of flyers under my door and also posted the flyers in my building, these flyers contained the group name that I came up with, and also someone kept on calling me private on my cell without saying a word just breathing hard on it. I find it disrespectful that after he didn’t want to have a discussion about what happened he disrespected my place by basically rubbing on my face that he is using the name and dropping unsolicited mail at my HOME, plus calling my cellphone private to bother. (no one calls me blocking their number)

Adding to the mess. His younger sister is currently crashing at my place and I was thinking about taking away the keys away from her for safety purposes as he already disrespected my home, therefore I don’t want to give him margin for anything else to happen.

I thought about 3 solutions:
1. I was thinking about letting the whole thing go and keep on doing promotion with another club which I already started doing

2. Going after him and making his life a living hell by putting a restraining order on his head and start working for the same club as he is now, so he has to step out and keep a distance by law. And also sell him out with his old affiliates by letting everyone know that he is now working with the competition ripping their posters and giving inside information that he wasn’t supposed to be doing.

3. Your opinion. How do you think that I should handle it?

I would try and stay away from that type of person. It’s usually better to go on with your life, make your own life better, because bringing someone else down doesn’t bring you up. If you don’t respond, eventually they should get bored. He probably enjoys seeing people frustrated and if you don’t rise to it, he himself will get frustrated and stop doing in. If the person calls again, try just laughing at the breathing and how pathetic it is. (might really piss off the caller)

Regarding the sister: If they are really close, I would suggest taking back the keys. Otherwise, it’s not really fair to punish the sister for the crimes of the brother. At a minimum, I would talk to the sister. Depending on the situation, consider telling her that you don’t blame her for any of these problems and would like to stay cool with her. If you do take back the keys, odds are the word will get back to the guy and he’ll try to cause more problems with you.

If what you’re saying is all true, more than likely, he will crash and burn on his own. Since you recently worked with him, try to distance yourself from him as much as possible so that you aren’t burned by the flames of the wreckage.

In response to a recent letter to Adobe School purchase Affiliate partners.. journeyed.com.. I got this attachment. I found it very informative? What do you think?

Journeyed and the software manufacturer Adobe understand that many customers may have multiple computers. Unfortunately the software manufacturers offer their products at an academic discount in order to assist faculty and students with their educational needs. It is not their goal to provide a copy for each computer owned by a customer therefore they have restricted academic versions to 1 copy per each qualified student/faculty. A full store version will usually allow you to download it more than once for all of your computers. Aprox 2-4 times per full version copy.

As a student/ or faculty member.. you are eligible to purchase only one copy of each software at the educational discounted rate. There is zero difference in the software. However, the student version is only downloadable once and it does not come with the flip thru paper booklet guide. It just comes with the full DVD-ROM software sets. You can get many variations of these tutorial booklets in any case at Barnes and Noble or Borders books. And with the money you save on student versions, you will have thousands of extra dollars to buy all these frills and maybe even a new pc or laptop. And of course there’s allways tutorials on wwwyoutbe.com

In the future; Should the product you purchase release a newer version you can then purchase 1 copy of the new release on your student id again and again and so on. If a street customer, or someone no longer enrolled in school needs more copies of a particular software.. they would need to then purchase the commercial version product at full price. But for all the extra money they will also get the tutorial flip thru paper booklet with their full version.

If there is more than 1 academically qualified person at any same residence, additional academic proofs can be submitted on that home account to allow additional purchases of a desired product to be made. Instead of just one per houshold. The internal tracking at Adobe is just to make sure who and how many they are buying. And they generally track purchases by address and name to prevent Scam and Software Burners from ordering tons of all the most expensive programs. You can buy only one of each of any software set or program as a student. There are dozens of varieties and you are able to purchase one or all of any/all of them. Adobe programs need a key and a serial number to be activated, they come with this in the DVD-ROM software case once verification has been submitted.

To buy from a student on ebay, you will want to make sure the student has not opened it, or at least make sure they have the serial key numbers that came with their set and offer a refund if it doesn’t work. This way their version should work for the next person to aquire the software set. And there is no reason it shouldn’t. Adobe has no way of tracking who has it once it leaves their wearhouse paid for and with the serial numbers/ key number enclosed. They are not gps satellite or ein tracked programs, nor can they be, and most importantly- Adobe cannot read your intentions to sell your work if you created it with student discount purchased software, versus full price retail version software. The distinction between software and hardware is sometimes confusing because they are so integrally linked. Clearly, when you purchase a program, you are buying software.

I’m looking to add an RSS feed to my website that I got from being an Affiliate Partner of eBay. I want to display in a fixed position on the bottom of my website the current auctions that are going on for my product. RSS seems to be the best way to do this, but I can’t figure out how to style or it, or can’t seem to find some sort of widget that will allow me to display this on my website. Here is my RSS feed:

It sounds like you just want to display an RSS feed within your HTML website. The easiest/best way to do this is to use RSS2HTML a free PHP script. This means that you can retain the complete control of the HTML layout (using templates) and make it match your existing design. Additionally using PHP rather than JavaScript will mean that search engine spiders can "spider" the contents of the RSS feeds.

I did my Ph.D. by distance learning through Indian Management school & Research Centre from the University of Northeast Virginia in 2005. Today I am well settled and woking in a very good IT company as a General Manager - Operations. My company had promoted me once I did my Ph.D. from this University.
